It was not a family affair as a member of the Adepo Family today (14th December 2021 pointedly told Justice K. B. Olawoyin of Oyo State High Court sitting in Ibadan that four (4) acres of land, the subject matter in suit number J/855/12, belong to the claimant in the suit, Bishop Oludare Famodimu belongs to him.

Alhaji Wahab Gadeyakan, a licensed surveyor and a cousin to the first defendant, Akinade Murufu Ajayi, told the court that the four acres of land in dispute was originally owned by the first defendant grandmother and it was sold by the first defendant Aunty identified as Madam Ibironke Ajayi who happened to be the sister of the first defendant’s father.

He said the land was sold to one Mr Dokun Tinubu when the elder brother of the first defendant has a court case to get money to settle the case and it was Mr Tinubu that sold the land to Bishop Famodimu.

He further made it known that the first defendant, unbeknownst to some members of the family, went ahead to sell the same land to another person identified as Abiala and that when it was discovered by Mr Tinubu, the Adepo Family gave the said Mr Abiala a ten (10) plots of land from the Adepo Family lands to avoid issues for the family with Mr Tinubu who later sold the land to Bishop Famodimu.

The claimant, Bishop Famodimu however adopt his statement on oath and also tendered documents including Certificate of Occupancy (CofO), Land Agreement and Survey Plan of the land to the court which were admitted as exhibits in the suit.

Two other witnesses who were in court could not give evidence. Counsel to the claimant, Barrister Ajayi Olaniyan’s plea to have the two other witnesses give evidence as he had to guarantee their safety as a result of threats from the defendants before they could appear in court today could not sway the court.

Justice Olawoyin thereafter adjourned further hearing in the suit till 22nd February 2022.

Akinade Morufu Ajayi, Wasiu Muniru and persons unknown, all of Adepo Family of Kute area, Ibadan were accused of trespassing on the land in question situated at Asaaju Village, Jenriyi area of Lagelu Local Government Area, Ibadan.

The defendants were also accused of obstructing and stoppage of construction work without any lawful justification or authorisation.
