An Oyo State High Court sitting in Ibadan, today Friday 17th September 2021, ordered the Federal Government of Nigeria to pay the sum of N20billion to Chief Sunday Adeyemo also known as Sunday Igboho as damages for the unlawful invasion of his residence.

The court order followed a fundamental human rights enforcement suit filed against the Attorney General of the Federation (AGF) and Department of State Service (DSS) Oyo state over the invasion.

It will be recalled that on the 1st of July 2021, the DSS stormed the Soka, Ibadan residence of Chief Adeyemo at about 1 am, broke down gates, doors, shot at his cars, damaged lots of properties. The secret police also reportedly blocked Chief Adeyemo’s bank accounts, and in the course of the raid on his residence killed two of his guests while some members of his household were arrested.

Justice Ladiran Akintola, while delivering his judgement, held that the style and procedures adopted by the DSS on the invasion of Chief Adeyemo’s residence were not only unprofessional but also condemnable and unlawful

The court further held that the DSS violated the fundamental human right of Chief Adeyemo and inflicted trauma on the applicant, his household and the entire neighbourhood.

The judge observed that the officers that carried out the operation would have been held liable were their identity known as they acted without a warrant or court order against the applicant.

While noting that there no iota of doubt the respondents invaded the applicant’s residence based on his agitation for self-determination and to prevent him from moving around the South-West states in pursuit of his agitation, Justice Akintola insist that the very act of the respondents is a violation of his (Chief Adeyemo’s) fundamental human right of Self-determination as every individual has the right to self-determination.

Justice Akintola said that the applicant has demonstrated to the court that his fundamental human right to personal liberty, right to life and self-determination was violated.

The court, therefore, restrained the respondents from further harassing and blocking the applicant’s account, adding that there was no justification to do so and awarded a cost of Twenty Billion Naira (N20 billion) as exemplary and aggravated damage in favour of the applicant against the respondents and N2 million ad cost of instituting the action.

Yomi Aliyu (SAN), counsel to Chief Adeyemo, while speaking with Rulers World correspondent in court, described the judgement as a victory for democracy and the rule of law. According to him, the judgement is historic and lawyers yet unborn will refer to it in fundamental human rights suits.
